Terms of Service

These Terms of Service (“Terms”) govern your use of the Serai mobile application and related services (“Serai”, “we”, “us”). By accessing or using Serai, you agree to these Terms.

1. Application use

Serai provides an emotional wellness experience, including mood tracking, conversational AI features, and related content. You must be legally able to enter into a contract in your jurisdiction. You agree to use Serai only for lawful purposes and in accordance with these Terms and our Privacy Policy.

We may update the app, features, or these Terms from time to time. Material changes will be reflected by updating the “Last updated” date below. Continued use after changes constitutes acceptance where permitted by law.

2. Subscription terms

Certain features may require a paid subscription. Subscriptions are billed according to the plan and channel you choose (e.g. app stores or our web checkout). Prices, billing cycles, and trial terms are shown at the point of purchase.

• Your subscription renews automatically unless you cancel before the renewal date in accordance with the platform’s rules (e.g. Google Play, App Store, or web billing).
• Free trials, when offered, convert to a paid subscription if not cancelled before the trial ends, as disclosed at signup.
• We may change subscription plans or pricing with reasonable notice where required by applicable law.

3. User responsibilities

You are responsible for:

• Keeping your account credentials secure and for activity under your account.
• Providing accurate information where requested.
• Not misusing Serai (e.g. attempting to disrupt services, scrape or reverse engineer except as allowed by law, or use the service to harm others).
• Understanding that Serai is a wellness support tool and not a substitute for professional medical, mental health, or emergency care. In an emergency, contact local emergency services.

We may suspend or terminate access if you materially breach these Terms or if required for legal or safety reasons.

4. Medical disclaimer

MEDICAL DISCLAIMER: Serai is a wellness support tool only. It is not a medical device, not a substitute for professional medical advice, diagnosis, or treatment. Never ignore professional medical advice because of something you read in Serai. In an emergency, call emergency services (or your local equivalent) immediately.

5. AI disclaimer

AI DISCLAIMER: AI-generated responses are for general wellness support only. They may not be accurate, complete, or appropriate for your specific situation. Serai is not liable for decisions made based on AI-generated content, to the fullest extent permitted by applicable law.

6. Account suspension and termination

We reserve the right to suspend or terminate accounts that:

• Attempt to manipulate or abuse the AI;
• Violate these Terms;
• Engage in fraudulent activity; or
• Attempt to circumvent subscription or usage limits.

7. Force majeure

Serai is not liable for failures or delays caused by circumstances beyond our reasonable control, including third-party service outages (for example OpenAI, Supabase, Firebase, app stores, or payment processors).

8. Payments via Paddle

Where you purchase or manage certain subscriptions or payments through our website, checkout and payment processing may be provided by Paddle as the merchant of record. Paddle’s terms and privacy policy apply to those payment transactions in addition to these Terms. By completing a Paddle checkout, you authorise Paddle to process payments as described at purchase.

9. Intellectual property

Serai, its branding, software, and content are protected by intellectual property laws. We grant you a limited, personal, non-exclusive licence to use the app as intended. You may not copy, modify, distribute, or create derivative works beyond what the law or we expressly allow.

10. Disclaimers and limitation of liability

Serai is provided “as is” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

11. Governing law

These Terms are governed by the laws of Turkey, without regard to conflict-of-law principles that would require another jurisdiction’s laws to apply, except where mandatory consumer protections in your country cannot be waived.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Turkey, where such jurisdiction is valid and enforceable under applicable law.
